Terms of Service
These terms govern your use of Feedback Magic ("the Service"), operated by Brincore ("we"). By creating an account or embedding a widget you agree to them. Questions: info@feedback-magic.com.
1. The Service
Feedback Magic provides embeddable feedback, survey, and annotation widgets and a dashboard for reviewing what they collect. You embed a widget on your site with a publishable key; submissions are delivered to your workspace.
2. Accounts
You need a valid email address to sign in (we email sign-in links; there are
no passwords). You are responsible for activity in your workspace and for who
you invite to it. Keep API tokens (fm_sk_…) secret; anyone holding
one can act on your workspace within its scope.
3. Your content
Everything collected through your widgets — feedback, survey responses, annotations, screenshots — is yours. You grant us the rights needed to store, process, display, and (if you enable an integration) forward it, solely to provide the Service. You are responsible for your own privacy disclosures to your site's visitors, including anything your widget configuration captures (such as screenshots or email addresses).
4. Acceptable use
Don't use the Service to collect data unlawfully, to harvest sensitive data without a lawful basis, to send spam, to attempt to access other workspaces' data, or to probe or disrupt the Service. We may suspend workspaces that do.
5. Plans, trials & billing
Paid plans are billed as recurring subscriptions through Stripe. New subscriptions may include a free trial (one per customer); you can cancel any time from the billing portal and your plan runs until the end of the paid period. Plan limits (projects, widgets, members) are enforced by the Service and described at the point of purchase. We may change pricing with advance notice; changes take effect at your next renewal.
6. Availability & support
We aim to keep the Service available and your data safe, but the Service is provided "as is" without warranties of any kind, express or implied, including fitness for a particular purpose or uninterrupted operation. Support is provided by email on a reasonable-efforts basis.
7. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, or for lost profits, data, or goodwill. Our aggregate liability for any claim relating to the Service is limited to the amount you paid us in the twelve months before the claim.
8. Termination
You may close your workspace at any time. We may suspend or terminate access for breach of these terms, with notice where practicable. On termination we will, on request and for a reasonable period, provide an export of your workspace's submission data.
9. Changes to these terms
We may update these terms; material changes will be announced to customers by email at least 14 days before they take effect. Continued use after that date constitutes acceptance.
10. Governing law
These terms are governed by the laws of the United States and the state in which the operator is established, without regard to conflict-of-law rules.
